Last Minute Driver is a trading name of Last Minute Driver Ltd (SC752230), 27 Tay Walk, Glasgow G67 1BU.
By using the our service you agree to our terms.
Merchant: A vendor who requests the services of Last Minute Driver through it's device application.
Courier: A delivery person who has made themselves available to collect an order from the merchant and deliver the order to the merchant's customer.
Customer: We define a customer to be one who has made an order to the merchant, either directly i.e. telephone or indirectly i.e. through the merchant's online ordering partner.

1. Use of Service
A Merchant may request our service through our App by following the flow process set out by Last Minute Driver when signing up during the registration process and through no other method. The merchant will be shown a cost of service at the time of requesting a courier where they can press 'Accept' if they wish to proceed with our service. Once accepted, a request cannot be amended and can only be cancelled if Last Minute Driver are unable to find a suitable courier.
The Last Minute Driver app is available on a 24 hour, 7 days a week basis, however we cannot guarantee that we will be able to fulfil all service requests at any given time. Last Minute Driver cannot be held responsible for lost revenue where we are unable to supply a courier at the time of request.
2. Delivery Fees/ Courier Wait Times/ Order Delivered
Last Minute Driver's delivery fee's may vary due a variety of factors and are not inclusive of VAT. Examples of which are below and not exhaustive:
Distance from merchant to customer (and back to the merchant as detailed in Section 3).
On Peak/Off Peak demand for use of our service
At it's own discretion, the merchant may charge part or whole of the delivery fee to the customer.
At the time of request, the merchant agrees that the order is available to collect upon the couriers arrival. The courier will be required to wait for up to 5 minutes to allow the merchant to retrieve the order, however after 5 minutes it will be at the discretion of the courier to remain at the merchants location and may cancel the order due to the order not being ready. If an order is cancelled by the courier due to the order not being ready, the merchant will be required to request a new courier once the order is ready. We may charge the merchant for services lost.
Last Minute Driver determines an order being delivered under the following circumstances:
Direct hand-off to the customer or person who has accepted delivery at the address given.
Hand-off to the premises where the merchant has stated the customer would be. This could be left with a company representative if delivering to a business or in a doorway or safe place of the premises where no one is available to hand off to.
Last Minute Driver and it's couriers will try their upmost to ensure each order reaches the customer in an acceptable condition, however the merchant accepts that neither Last Minute Driver or it's couriers cannot accept responsibility for any order that does not reach a customer in an acceptable condition due to something that is not within our control. i.e. the hot order was cold by the time the customer arrived at the safe place due to not being available to directly hand off. Any refund claim that was within our control will only be for the cost of the service provided by us. Any other claim may be declined. All successful claims will be returned to the merchant's credit balance as detailed in Section 4.
3. Pre-Paid Orders & Cash Orders
Pre-paid orders can be accepted by all Last Minute Driver couriers. No monies are to be exchanged between the merchant and courier (except where the customer has pre-tipped, see Section 7 on Pre-tipping).
Where a merchant chooses to accept a cash order from a customer the merchant must satisfy themselves that all cash orders accepted by them are genuine. The merchant agrees they remain responsible for the order until the courier successfully completes the delivery. Couriers have the option to opt in or out of accepting cash orders. This may mean that there may be less couriers available to accept a cash order even though there are couriers in the vicinity of your location.
Once a courier arrives to collect a cash order from your location, the courier will pay for the entirety of the order. This may include food and drinks, services fees, delivery fees etc.
Example 1:
1. Customer makes order directly to merchant and requests to pay cash upon delivery.
2. Food order £15.50
Delivery Charge - £3.99 (amount charged is at merchants discretion)
Total Bill - £19.49
3. Merchant requests courier
4. Courier Arrives – Pays £19.49 to merchant
5. Courier takes order to customer – Collects £19.49 from customer and is reimbursed.
6. Order Complete
Example 2:
1. Customer Orders through Online Ordering Partner – Selects to pay cash upon delivery.
2. Food Order - £10.99
Service Charge - £0.50
Delivery Charge - £2.99 (as set by merchant with Online Ordering Partner)
Total Food Bill - £14.48
3. Merchant requests courier
4. Courier Arrives – Pays £14.48 to merchant
5. Courier takes order to customer – Collects £14.48 from customer and is reimbursed
6. Order Complete.
If a delivery cannot be completed by the courier once the order has left the merchant, the courier will return to the merchant to return the order and all monies that has been paid to the merchant will be returned to the courier. This includes any food and drinks order, service fee's, delivery fees etc. For clarity, the courier must be refunded all monies they paid for the order.
Example 1:
1. Customer makes order to merchant through an Online Ordering Partner.
2. Food Order £12.50
Service Fee £0.50
Delivery Charge - £2.49 (as set out by merchant with Online Ordering Partner)
Total Bill £15.49
3. Merchant requests courier Courier Arrives – Pays £15.49 to merchant.
4. Courier takes order to customer but no answer at door. After a number of attempts and phone call's to customer. The order becomes undeliverable.
5. Courier returns merchant to return order.
6. Merchant returns £15.49 to courier and is reimbursed.
A dual signed receipt (by both courier and merchant) of the refund should be kept by the merchant to show proof of payment to the courier. In the event of a dispute where no proof is provided, Last Minute Driver may deduct payment from the merchant by the terms set out in Section 4. The merchant will be charged an additional mileage fee that is determined by the distance from the customer's address to the merchant's location. Last Minute Driver may also charge an admin fee that will be a percentage of the additional fee to cover our costs. The fee(s) will first be deducted from your credit balance, if any. If there is an insufficient credit balance we will deduct the remaining/all of the fee via the card saved.
4. Authority to hold Card Details
As part of the registration process you agree that we may save the card details provided and we may deduct payment from you for the following reasons:
Each time you use our service through our Pay As You Go (PAYG) method.
'Topping Up' your account which we will hold as a credit balance.
Automatically 'Topping Up' your account once the credit balance falls below £10.00
Where the courier is entitled to receive an additional mileage fee plus any necessary admin fees due to an undeliverable cash order and there is an insufficient credit balance.
Any disputes over pre-tipping where we find the courier was entitled to receive a pre-tip and we have reasonable grounds to believe this was not passed on by the merchant.
Any other disputes where Last Minute Driver finds that either Last Minute Driver or it's couriers are entitled to be compensated for.
We will advise if we are to deduct more than what has already been agreed at the time of the original request of service.
Where the merchant is to be refunded, we will issue a credit balance to their account. A merchant can request a refund of their credit balance by e-mailing restaurants@lastminutedriver.info.
5. Support Service
Last Minute Driver provides support via it's app where the most common questions can be found under the Support Service tab. FAQ's are also available by visiting www.lastminutedriver.info/faqs. Further support is available by e-mail restaurants@lastminutedriver.info
6. Disputes
Last Minute Driver may be contacted by both Merchant and Courier regarding disputes. Last Minute Driver will investigate any disputes and will make a decision whether to uphold or decline the dispute. Our decision is final.
7. Definitions
Pre-tipping: Where a customer pays gratuity to the merchant direct which is to be passed to the courier either by the Last Minute Driver app (currently under development) or cash direct to the courier. A courier is to receive 100% of any tip offered by the customer. A dual signed receipt (by both courier and merchant) of the transaction should be kept by the merchant to show proof of payment if cash has been paid.
App: An application that is available to download to a mobile device from Apple's App Store or Google's Play Store.
Pre-Paid Order: Where a customer has paid in advance for their order.
Cash Order: Where a customer chooses to pay the courier cash upon delivery of the order.
8. Promotions
From time to time we may run promotions to help promote our business. Our promotion can end at any time and without notice. We may also end any promotions earlier than the advertised end date.
Merchant Sign-Up credit
We may offer credit to merchants in certain areas as part of their registration. The merchant and it’s premises must be new to our platform to be entitled to any credit. There are no cash alternatives. If a merchant has more than one trading name at the same premises, we will only credit one of the trading names.
A credit will be applied after a qualifying amount of deliveries has been completed.
Cashback Offer
From time to time we will offer cashback to merchants who complete a certain number of deliveries within a set period. Any cashback offered will be credited to the merchant’s balance. There are no cash alternatives.
9. Updates to this notice
We may occasionally update these terms and conditions.
We may occasionally update these terms. If we make significant changes, we will notify users in advance of the changes through the Last Minute Driver app or through other means, such as email.
